Under Florida law, it is illegal to operate a motor vehicle with a blood alcohol concentration of .08 percent or higher. Any person found in violation of this law will be arrested and booked on DUI charges. As soon as you are arrested, the police will confiscate your driver’s license. The only way you can regain your driving privileges is by scheduling an administrative hearing with the Florida Department of Highway Safety and Motor Vehicles. At the hearing, you and your attorney will have an opportunity to contest the suspension of your license, and fight to have your driver’s license reinstated. It should be stated that it’s very important that you schedule this hearing in a timely manner. If you do not schedule your hearing within 10 days of your arrest you will lose your right to a hearing altogether.
In addition to the DMV hearing, you will also be required to address your DUI charges in criminal court. If you are ultimately found guilty of the charges you could be sentenced to:
- Up to 6 months in jail
- A $250-$500 fine
- 180 days to 1 year driver’s license suspension
- 50 hours of community service
- Up to 1 year of probation
- Mandatory DUI classes
These penalties may increase depending on the facts of your case. For instance, if you have multiple DUI offenses on your record, you will likely face enhanced penalties. Having a minor in your vehicle while driving under the influence, as well as causing a DUI accident with injury will also result in enhanced penalties, and possibly additional criminal charges. |
